The article says it was during a test back in 2018 so it wasn’t even a race. And why did he wait 6 years to file suit?
I'm all for safety and a LOT of the BSB tracks due lack some solid safety measures. That said, no one... ESPECIALLY a 6-time champion that has sure ridden at the track previously... would ride an event if they thought the risk was too great. I feel bad it ended his career. The same way I feel bad other racers have had far more serious injuries, like death. Still, no one is jumping on a bike in a professional series without understanding death or serious injury is ALWAYS possible. The ONLY argument that "could" be had rationally would be "IF" the organizers always use an air-fence for that particular place during all prior testing and races, and decided to pull it away. Further, I think it a 6-time champion should have the ability to assess if that change would be deemed safe themselves having the best understanding of the complexities and potential outcomes of all types of crashes they experienced and witnessed throughout their career. Overall: Very Lame.

I'll withhold judgement until we hear the details, but sounds pretty messed up. He won't be welcome here.
Compared to some of the shenanigans he got up to for Fast Bike magazine before he got serious about racing. I think he's seen close enough. He and Frosty put them selves into the scenery a number of times for video content. Like many of you I'm disappointed in Shakey taking this to court this long after the fact. He's got a very impressive collection of sportbikes and racebikes. If he's short of money those should probably go first, before suing over this.
So, why isn't the bike manufacturer and team named in the suite as well? Their argument would make me lean towards a bike malfunction, not an unsafe track.
This is the same guy that used to be part of those bullshit videos violating every road law with no regard for anyone's safety, right? If so, the irony is a bit thick.
I don't know anything about the British legal or insurance system, but could this be the insurance company suing on his behalf? I have had 2 incidents where my insurance pulled this one on me, one Business and one personal. When you sign off on a claim, you often authorize the insurance company to sue in your name to reclaim thier loss. One of mine was a suit against my then current employer, and I had no idea it was going on until the business owner called me to ask what the heck was going on. Go ahead and prep the pitchforks, but personally I would wait until all the details are released to chase him down.
That was my thought but I didn’t want to speculate as the article didn’t give any details of his injury. I had a bad car accident in the month of December many moons ago where the other driver was at fault. Thankfully his insurance company paid all my medical bills and lost wages and replaced my car. Of course they wanted to settle immediately. Very cordially I told them I was not ready and I needed to go through PT and heal and make sure it didn’t affect my quality of life forever as I was an avid rider at the time and just getting into track days before going racing. Told them I wanted to get through the Summer then I’d talk to them again in the Fall. Thankfully I healed completely and have no long term effects from it. I settled with them in October and made a nice chunk of change that allowed me to pay off all my bills. But that was less than a fucking year! Unless there were some new discoveries about Shakey’s injuries and long term prognosis I just can’t understand why it would take so long to file the lawsuit.
He rode for Paul Bird so I'm fairly certain he has seen the Macau GP although I don't recall if he raced there. Hutchy raced Shakey's championship winning bike at Macau when he was Shakey's teammate at Paul Bird. Shane has been around and has a more extensive racing history than most riders on the planet. Which makes this suit all the more ridiculous. This was also Shane Byrne. I was watching the race when he did it. Later he got Me Too'd over it and had to do a PR apology. (Obviously not an F1 driver but it's the internet so...)
This from the guy that shot how to pull wheelies and influence people? Circuit racing is the least dangerous thing he did. Go check out the old FastBikes VHS tapes. Between him, Rob frost, Gary Mason, Colin Schiller, Jimmy Miller and the rest of the crew almost every ride ended up with a trip to the hospital.
