If an impact bends that mid pipe then it hitting the swingarm is a moot point. Also it's not an Endurance bike, you don't stress as much over crashability as you do it's abilities on two wheels.
I get both of your points and considered them both before my comment but I still feel the same way. Sometimes it comes down to one single point after tons of time, money, and stress. And we've seen tweeked exhausts many times in impacts that dont result in a fall.
