But the parts in question were used. Are you buying brand new ones? Not being an ass, these are the things that will come up. He didn't pull that 2900 out of his @ss I'm sure. If he's got even decent lawyers you may end up with nothing besides a bill.
For the 11k reimbursement, I advised my legal counsel that i would either: 1. Leave well enough alone here or 2. Through both counsels, explain it was a mistake of some sort but that the matter had been resolved and i was made "whole" again. That was denied.
Trust me I get that 100%, let my lawyer buddy read parts of this thread and he laughed and said "that guy doesn't stand much of a chance without a lot of supporting evidence that they weren't changed and a fair amount of research on fair market value. The cost of digging all that up, reviewing it, etc you could buy 3 bikes and a box of those rod things. But saying that, f$ck him, I'd take him to court for just acting like an @ss".
Does that include labor? What about your own lawyer fees, missed time at work, transporation, etc. Trust me, I am totally against the "sue happy" people that slip in McDonalds (and suffer NO injuries) or get called a mean word, and decide to sue for $1 million for "damages". But in your case, I think you were justified in asking for more than $7k. I would want to sue for enough to make sure that I got the bike I was promised, without a single cent out of my pocket (including any labor or shipping fees, gas back/forth to Livengood, whatever), plus to cover any time missed at work, enough to cover my own lawyer/court fees, and then maybe another couple grand just for having to deal with all the bullshit. .02
Yes. That includes labor Im sure i could have surd for more. Im just looking to get what i paid for and be reasonable about it.
Sadly, the wheels of justice grind slow. In this case, I hope they grind very fine. OP, you gonna buy a Trebuchet with the winnings?
