Frivolous lawsuit against Keigwins trackday organization:gofundme link

    I just don't see the point of the gofundme.
    They they are right, they don't need it and if they are wrong, I'm not paying for their mistakes.

    I'm very interested in seeing the case filings. If anyone can find them.

    It really doesn't help that the guy is constantly flaunting his Ferrari's, motorcycles and exotic vacations on FB as well. Now we all know FB wealth seldom equals actual wealth, which makes this whole thing look shadier to me .

    im pretty sure u gotta sue a second time for legal fees even if u win in court. and if u do win that, u still had to pay some fees ahead of time. who knows what they need - lawyers, expert witnesses, documents, etc - none of it is cheap. so they very likely do need this $ now since their intention is to go to trial.

    btw, im not a lawyer. I just hang out with lawyers sometimes.

    Well, beyond the gravel pit is a tire wall and then over that is the out edge of the pits I guess.....you think that spot marked by the arrow is the vicinity of said ditch, and I wonder if this exposed pipe in question is on the inside or outside of the tire wall.

    And to not make Turn 3 to that level means you didn't even attempt to take Turn 3. You should be crashing further right in the picture.

    Topic for another thread, but Monterrey has been stealing the profits from the track for years and not reinvesting as they were actually chartered to do when they were given the land to use for a track. They're bleeding it dry until they can claim it has a cashflow issue so they can close it down. That makes it easier to sell to the public (why are we financing a racetrack with our taxes?!). Shutting it down to make the rich people happy who built their mansions next to a racetrack and were surprised by the noise. [Un]popular opinion is that the track will probably cease operations after the contract with SCRAMP runs out in 2020 I believe.

    Rules for attorney conduct vary by state. If it’s truly frivolous, the attorney could be sanctioned.

    I don’t practice civil law, but i know a defendant can file a motion for summary judgment, which is basically telling the court, “hey, there’s literally no possible way they can win, even if they prove what they’re alleging.”

    That can be for all sorts of reasons.

    The system really does tend to work for most people. The deepest pockets and best attorneys in the world don’t change the facts.

    Hey, I mean pre-nups get thrown out by judges from time to time. Maybe this putz can claim he was drunk or medicated or under some other sort of duress when he signed the trackside waiver and didn't know what he was doing.

    I had to explain the word SHEAR as in shear strength of a bolt that broke, seems he had never heard the term.
    I kinda had fun playing with the stupid. still not sure if it was an act or not. They try to get you to slip up over mundane things asking stupid shid, over and over different ways until they get the answer they want

    I couldn't access the actual pleadings of the case, but was able to get the docket sheet (attached to this post, and can be found here: https://portal.monterey.courts.ca.gov/case/MTdDVjAwMDg2OQ==#full ). It gives some basic info like the case number, the parties, the attorneys and where the case stands. The docket sheet indicates Dziurzynski is suing the County of Monterey, Sports Car Racing Association of the Monterey Peninsula (SCAMP), KEIGWINS@THETRACK, INC. and MAZDA MOTOR OF AMERICA, INC. d/b/a MAZDA NORTH AMERICAN OPERATIONS. Dziurzynski amended his complaint after KEIGWINS filed a motion to strike. To get the amended complaint, I believe Cali requires a request to be submitted and a fee to be paid of $.50/pg. (See http://www.monterey.courts.ca.gov/Civil/CourtRecords.aspx#Criminal5d). Maybe start a GOFUNDME to raise the funds necessary to obtain the amended complaint? :D

    I also found an article in "The Carmel Pine Cone" which gives a bit more detailed info, including an interview with Andy Swartz, the attorney for SCRAMP. The article is on page 3 of the paper (attached to this post, and can be found here: http://pineconearchive.com/170324PCA.pdf)

    So he was escorted off the track prior then ran off again ..... What a Dumbass...... Sounds like he needed this EGO Check....

    I thought insurance covered this end of it with the lawyer? Don't know what their insurance coverage is like but I figure it would have to be close to what Mongo said they have to carry. If his insurance doesn't cover this then this has been waiting to happen for awhile now I'm sure.

    Strange things are possible in the world of law, it's like The Twilight Zone…judges have been known to throw a few bones to their legal friends…anyone can sue anyone, it is winning and then collecting that can become problematic…

    Szymon's own comments on FB are that his insurance has already agreed to handle all of this without costing him anything. It makes less and less sense the more I read. On top of that, he easily has 50k laying around .

    I can guarantee the Attorneys are winning . They get paid weather or not it's frivolous :D
    Edit; I think I used the wrong spelling of weather in this instance.. but I don't care :D
