Really. You don't need a handwriting analyst for that one.

Disagreeing with her doesn't mean she's wrong either. You seem to think your involvement with nonprofits somehow gives you greater expertise than the judge. The legal analysis I read was sound - regardless of whether or not you agree with it.

You (and Mr. Inge) are going to need to accept the possibility that the CMRA BOD is acting unethically, but not in a manner that creates grounds for any kind of court-enforced remedy.

Ok so now im hammered cause i had help editing this crap.
Seeing as all i get is shit sbout my writing.
Maybe some of you should accept the fact that the BOD caused all this in 1st place.
By law anyone can ask for the financials of a non proft organization.
Yet they to this day have refused.
So lets not have the facts and law get in way of a Peyton and Steven burn fest.
Why miss an opportunity to trash us.
Appeals court will solve judges decision in due time.
And who is still covering the people in lawsuits lawyers bills?
    The club is.
So if they have nothing to hide why spend so much to defend?
But guess you all like NASCAR for the crashes and not the competition on track.
Im going to torture you by not having my wife edit my writng.
    Have a great day everyone.

You are correct that nonprofit orgs must make their 990 form public. I'm not sure what the penalty is if they don't, but I presume the organization's nonprofit status would be revoked if they're not in compliance with that requirement. With that said, you can request those documents from the IRS just as easily as from the club. If that is one of the goals of this lawsuit (either to obtain the 990 form, or to have the club's nonprofit status revoked), then that should have been stated in the initial complaint. The decision linked makes no mention of any request for such relief.

The decision linked also dismissed the club as a party to the current suit. IF the club is paying for the legal fees of the individuals named in the suit, then it's up to the members as to whether or not that is acceptable.

I don't know you. I don't know Mr. Inge. I have never met (to my knowledge) any member of the CMRA board of directors. I am not a CMRA member. I have no dog in this fight. I just find the legalities to be interesting. Based on what I've read in that decision, I think you're bringing up concerns that, if true, are extremely legitimate - but if I were your attorney, I would probably be advising you that your odds of relief are very low, and your best course of action under these circumstances is to take your ball and go home. Start a competing club, and poach the CMRA members who you claim are being exploited by their board's alleged deception.

Wait so did a Federal judge say the CMRA isn't required to follow state business laws? If so, that has some far reaching implications.

No idea, I suppose that it's the clubs bylaws stating that members can but in reality they don't adhere by their own bylaws.
