Depending on what they're defining, that's in line with what we have over here, I think. In Mass. .05 - .08 can be prosecuted as "Driving While Impaired", but unlike OUI at .08+, supporting evidence must be supplied along with the breathalizer reading. They just changed the Statue of Limitations here, too. Used to be after six years of the first offence, it would be a first offense again. Then they changed it to ten years. Now it's lifetime.
