I did originally post what I believed to be the problem. I'm not 100% and haven't received any official word on the real issue. There are some things I did see and notice that raised some question marks. We are building race bikes and a lot of those things do not matter to me which might matter for street bikes. I'm continuing work on mine & Brian Halls bikes. Whatever the issue is, since these will only ever be race bikes I'm pretty sure ours will stay in house and parts fixes if any will be sent to us. I have no real issues with the bikes. I have dynoed both bikes and they are both doing great. We have some early release bikes as in being some of the first ones ever made and they are doing just fine. I can only speculate that Kawasaki is doing a good job taking care of this issue and getting the problem resolved quickly. Even after the fix everyone will have their bikes sooner than nearly everyone else. This bike is by far the best updated machine I have ever seen Kawasaki make. I can't wait to race it.

That is correct as when I had the cam / tappet issue on the 07 ZX-6R Kawi kept it on the down low and never released a service bulletin on it. Owners had to call the 1-800 Kawi support line to get info on the issue and how to get it resolved. Even the local service managers I brought it to were not in the know thus slowing service down.

So buyers will be "instructed" to return sold units for "full refund" What legal means can Mama Kaw bring to bear to force return? Does full refund include all taxes, dealer charges, extended warranties and money laid out for insurance?
it takes time to initiate a recall, legal has to be involved with the wording of the document, mgmt involved, engineering involved with the fix, any sub contractor involved (with there own legal team) on re-mfg the part etc... so when people hear of a failure it takes a little bit of time for everyone to get together to put it down officially on paper
