Lowering the limit for a DUI to .05?

    Wow, with all the attempts to deviate away from the .05 idea and defend driving while not completely falling down drunk, there sure sounds like there's a bunch of "I can drive even after a few beers" people here. Ask any drunk person if they're OK to drive and just about every one of them will say yes. That's the point of being drunk, you aren't capable of thinking or acting logically. Just one rule applies. If you want to drink a few then stay the hell off the streets while driving a vehicle. I don't want to die just so you can have a few beers and try to drive home yourself.

    You stand a much greater chance of getting nicked for a dooey if you're driving on the sidewalks, so I hope you won't mind if I ignore your advice. ;)

    Its "under the influence"... what about a nutcase that's "road raging" or the casual commuter scanning social media or text messages? Or the depressed housewife on some narcos? Why even allow "any" BAC content if it was truely about safety?

    DUI Laws crafted by Lawyers for Lawyer$....Legal Representation, DUI Schools...Breathalyzer Interlocks....Court Fees, Fines, Insurance Increases, Towing and Impoundment, Bail Bondsmen...all generate FUNDS...as soon as the Cop lights you up, TheMeter starts running, and doesn't stop till you get off probation, except they give you a break for the 1st one...Knowing You Are Coming Back...again and again.

    Stricter penalties hardly ever prevent people from breaking laws. A limit of .05 does nothing to keep our families safe, it does however line a lot of pocketbooks as Britt pointed out. Quit making laws based on emotion.

    In New York, if you have a dwi and blow a .18 or greater, the charge is changed to aggravated dwi and the fines are doubled

    If you're buzzed after the two beers that it'll take to shoot past the .05 then maybe you should stay out of bars?

    Well damn Britt, it costs money to do all those things. They fine a lawbreaker as a form of punishment and he/she is responsible for paying for it. That's why it's done. It's all punishment that's applied in an effort to stop that kind of stupidity. If people keep coming back again and again then remove their butt from the seat of an auto by permanently cancelling their drivers license, or let them sit in a jail cell until the need for drinking fades into the long past.

    Emotions are the start of many of the laws on the books. Whatever makes society suffer, both physically and emotionally, is what educated men try to eliminate. Life is precious, why endanger it just because someone wants to have a little fun and guzzle a few" Driving while drunk, even a little bit drunk, is one of the dumbest things that a person can do because it shows the total lack of respect for that person's fellow man by indicating that his personal desires are more important than anyone elses safety and security.

    "Hey everyone, I'm drunker than a waltzing piss ant and having fun so get your ass out of my way!" "I'm important here, not you people."

    IF, it were about "Punishment", there would be no DUI Schools or Work Permits...it would be LOSE YOUR FUCKING LICENSE... Instead, they hand out 1st offender trophies and reduced charges...what message does that send..."Its No BIG Deal".

    There's a difference between getting drunk and driving and having 1 or 2 beers with dinner and driving. Statistics show whatever you want them to. If there is an accident and there is any alcohol involved, no matter who is at fault, gets labeled as dui related. Pump up the numbers and use the classic "what if it was your daughter" argument. Feed to people's emotions and the money will flow, every time, guaranteed. Who do you think pushes for the laws? Just like everything else in life it's the people who will make the most from it.

    Pfft... 0.05 BAC is nothing. Arizona has DUI law that includes being impaired to the slightest degree. Every year or two you read about someone getting a DUI with a 0.00BAC. The Officer just needs to consider you are impaired to the slightest degree and you are subject to conviction.

    Example: Heather Squires was arrested for DUI without drinking a drop of alcohol

    By most standards, Arizona has the toughest drunk driving laws in the nation. A first conviction nets you:
    • 10 days in Jail
    • $250 court fine
    • $500 fine for constructing state prisons
    • $500 Fee to the Department of Arizona to arrest you
    • Approx $1000 in court costs
    • Approx $750 for installation of an ignition interlock device.

    39% of of traffic deaths are related to alcohol and that means that if a sober driver hit and killed someone who had alcohol in their system it still counts as alcohol related. 6% of those have a bac of .07 or lower. Yet 61% are killed by sober people. What are you going to tell the families of the 61% oh well? Your argument is illogical because you are not debating the thread, you are not showing correlation, you are not showing statistics what you are doing is using straw men. You are basing the fact that the government needs to continue to lower bac levels on wether or not someone is going to be callous and tell a person that lost a loved one to duo, we aren't changing dui laws because of their dead loved one. No one is making the argument to drink yourself into a drunken stuper and kill someone. They are making the argument that the level does not need to continue to drop. Looking at the data 6% versus 61% to me doesn't look like lowering the limit will have a big impact on traffic deaths even those that are alcohol related. But I know I know tell that to the families who lost a loved one.
