Depends I suppose on if the lawsuit was against the individual or the business. If it’s the individual for libel, then just because they separate from the business means nothing. If it’s against the business and an employee of that business, then I suppose it’s whether or not the new owner buys assets only or liabilities as well. If it’s liabilities, then new owner should ask for a Substantial amount to be held in escrow for a couple of years.
