You're not getting it. There is nothing pro-penalty about it. It's about goodwill. You ever see a tennis player asking for a point to be replayed even though the referee gave it to him, because he knows the ball was out/in? You know what the public does when that happens: loud applause. Whether he deserved a long lab or not is irrelevant. He fucked up and injure someone: fact. He was penalized: fact. He escaped to penalty through a technicality and now people are mad at him, including his competitors. This is where showing some extra class earns him some goodwill/karma points back. It's not always about being right.
That might actually hold some water, if this was the first time he injured himself riding like an asshat…
