This is why I said it’ll be interesting to watch this play out ... if they don’t settle. In order for them to “win” against him, they’d need to show that his term was justified because of his bias in the investigation. But in order to make that claim, they would seem to have to prove the bias impact. DC is an employment-at-will district, but I don’t know how the FBI operates on that front ... contracts, disclosures, agreements, etc. Long and short ... Comey’s getting PAID on this. In DoD world an affair is a reason to get your clearance yanked at a minimum (unless you self report it). And yes their phone is their phone. Destroying emails etc on it is a records violation. Not sure how the FBI works but I suspect similar.
In my world, DOE (Energy), it depends on your clearance level and where you work. At a minimum he'd of lost his clearance. My experience with these sorts of things is that everyone that gets fired from a Gov't job sues. There is a cottage industry of lawyers that specialize in this sort of work. Some win some lose. What I am curious about is if he in some way violated the Hatch Act.
