While I was at a track day my easy up got picked up in a gust of wind and scratched someone's truck. I had it secured to my trailer on two legs, the side the wind had been blowing from all day, and strapped to a toolbox on the opposite side (maybe 20/30lbs). A gust of wind coming from the opposite direction dragged the easy up and scratched the truck next to mine. The owner is now saying he wants me to pay for part of the $1500 repair. I told him when he turns in the truck at the end of his lease they will probably only charge him $200/$300 (I know this from recent experience with the same company) but he said he's going to buy it out, not turn it in. What do you think? I know the guy, and I reminded him that he recently just got sideswiped on track not too long ago and it caused him to crash, doing a lot of damage to his bike, and he didn't ask that guy to pay for his repairs. Same difference? Or no?
No. When you park your truck at the track, there is no expectations that it's going to get damaged. Not remotely the same as being on the track. It was your canopy. If it was really secured that well and it flew away anyway, maybe it shouldn't have been up in the first place. Pay the man his money.
Not the same ... at all. You bring a bike to the track prepared that anything might happen. That’s part of racing. But you don’t expect a new(ish) truck to get damaged sitting in a parking lot because someone else didn’t properly secure their stuff. You should do the right thing.
Your ezup got loose and hit his truck. Your fault not his. On the track is a no-fault zone. In the pits is just like the real world.
Like everyone else said. Had a wind gust fling my canopy up and over my trailer, and fling a mounted tire and wheel with it. Landed smack dab in the middle of the windshield of a truck. Thankfully it only hit the glass, no sheet metal damage. And it as my truck. Double lucky. But yeah. Fix his truck.
You did a shitty job securing your EZup. It fucked a guy’s truck up. If you didn’t do a shitty job securing your EZup, the guy’s truck wouldn’t have been fucked up. Therefore, you now own the repair. Cough it up.
I want to do the right thing but I'm not sure what exactly that is. Forking over $1500 isn't exactly painless and I think anyone would at least ask the question for opinions. Saying that it's "telling" doesn't answer the question.
Same exact situation happened to a buddy of mine at the track. The offender asked for a body shop estimate. My buddy got one, sent it to him and the responsible party paid the $1600 to my friend. Don't think at any point there was any wavering from the other guy.
Alright, I just sent him a message asking how much he wants me to send him. Just the way it goes I guess.
