One is active the other is more passive. Look at it as having to call the feds versus telling them how many illegals you had last year or even answering how many you have in jail if they call you. It's a pretty big difference really. You keep saying the Sheriff should have called - and I totally agree - but not doing so still doesn't break the federal law and that is what the discussion regarding the court is all about. The feds can request immediate notification all they like, the federal law does not actually require it.
