Playing a part in something and being criminally responsible are not the same thing. I am not sure what would be gained from her conviction even assuming that you could even find a jury that would convict. A good defense attorney could make her look the part of a victim, so it probably isn’t worth pursuing.

She would never be convicted, but she is responsible for placing her (unborn) child in harms way.

Just curious Jase, what if a pregnant woman (intending to keep the baby) was driving under the influence and had an accident causing the death of the unborn child. Charge or not?

Scientifically speaking, there is no question of when human life begins.
That science was known before Roe v Wade was decided.
The only question is, when do you as an individual decide that that life has value.

No, the only question is, when does the individual lose the right to determine if that life has value and must succumb to the force of the state?

True, I mean if the parent decides that their kids life has no value, they can just chain them in a room and serve them 1 meal a day.

Why waste the food? Or the room?

I had it right, thank you.
Your question is only salient to those who
think killing babies is a right. That goes well
beyond determining if a life has value.
There are a lot of people out there who have
no value to me but I'm not demanding the right to kill them.

I dont think she should be charged. Who wins in this situation if she gets convicted?

I see your point. And I agree with that to a certain degree, but, IMO, it all depends on the situation.

By your logic I can walk up to any pregnant woman, punch her in the stomach causing a miscarriage and there would be no reason to prosecute me because no one would win.

You're twisting my word. We are talking about two different things. In that situation, of coarse you should be charged. What i'm saying is that the pregnant mother that was shot in the stomach causing the unborn baby to die SHOULDN'T be charged with the death of her unborn baby.

But if the person in the other car was DUI, they would be charged.

If a mother drinks while being pregnant, and the baby dies, is she charged?
