Well, she's a fucking moron. The first does not apply to keeping a job. It applies to not going to jail. That being said I'd be very very very surprised to find that in Cali she can be fired for pretty much any reason. However, KP has huge pull so they probably will be able to do it under some healthcare exclusion they paid the legislature for.
Should NOT be fired. I didn't like her original post either however, and I don't know the WHOLE story either.
Why not? If her social media says anything about where she works then she is effectively a representative of her job. Posting shit like that in Cali no matter how true makes her and thereby them look bad. Make your employer look bad and buh bye.
It's painful how many people have no idea what the First Amendment actually applies to and just go around yelling "BUT MUH FREE SPEECH!!!"
Good to know but that was my version of the inane comments people were posting! I just heard that Nelson's is considered the biggest tire dump in the 4 state region that the EPA lists it in so they are being very careful with what they allow them to do as it will set a precedent for other places.
We used to deal with people screaming that same phrase on a couple large motorcycle forums I moderated on.
CA is an at-will employment state. By the very definition, either party can terminate employment at any time, with or without cause.
The First Amendment does not apply to private sector corporations - the constitution exists to prevent the government from suppressing the people, not the private sector. As long as the company isn't breaking any other employment (or other) laws, you can be terminated for running your mouth. Many companies have social medial clauses in their employment contracts - if you are inflammatory online and shed poor light on yourself and, in turn the company, you void your contract.
It's 2018. She got fired for being stupid. Kind of ironic. Who doesn't know today about the consequences of social media?
