I don't want the same thing that happened to me to happen to others on this forum. A friend of mine helped me find a motor from here for my GSX-R and after talking with the guy and seeing pictures I was very happy to find a 750 motor in such great shape for 900 shipped. Well that isn't what I got and this seller seems to not want to try an resolve things at all. So now I have contacted a lawyer and we are finding out the next steps to take. The seller is(jessi0328) Bob.

A few detailes: after I paid him he decided to take off the hoses, pair valve, oil pan and starter to ship them seperate okay no biggie well the box cam and the oil pan was missing a chunk and the starter was not even in it. Here are some pictures of everything I got for what I paid it all should have been proffesionaly packed instead it looks like he threw it together knowing the motor was shit hoping to blame it on the rough shipping just look disgusting.

the back motor mount is all bent up and cracked. my guess is he could have it fixed, but the guy should ahve been honest, not a dumb shit, and sent it the right way so nast can just put the motor in and ride his damn bike. this shit aint right at all. wish i was closer to this guy to go pay a visit

I just got screwed on e-bay for a Woodcraft engine cover that doesn't fit what he advertised. I'm waiting to hear from him so I'll give him the benefit of the doubt for now.

wow i cant believe what im seeing. Yes motors need to be on a pallet. However i have shipped one in a box before but i wrapped the motor in garbage bags and put it in the box, then filled the box with expandable foam so that there was no movement. Then after that i re-enforced the outside of the box so it would not split or bust. it worked well but way to much work. Stick with the pallets.

This motor is actually in worse shape than the one in the bike both now need a lower case and this one needs much more than that I apologize about the picture quality but I didn't have my good camera when it arrived yesterday. I am pursuing my legal options and we will see but I do think this kind of thing should not be allowed and for paypal to tell me they can't dispute it is just ridiculous even if it was in a box it should have been packed not to move and not with foam getting all inside the motor. I would have to split the cases and clean the entire motor I am looking at a ridiculous amount of money. I guess I have to get another motor so I can actually rebuild the one in the bike that was the point of getting it.

Best (cheapest) option is small claims court. usually up to $2k depending on your state. Just pay the filing fee typically less than $100 and you dont need a lawyer. case is heard by a judge.

Hell, get it on a docket then you can put Judge Judy on his ass

I tried paypal and within 30min they closed the claim siding with him saying they only protect goods not the quality of goods I spent a while on the phone after just to meet a wall. We will see what else I can do in the mean time I need to get another motor so I can get the bike back out ASAP this guy has been a major set back I already lost last season due to rebuilding the rest of the bike.

If you payed paypal with a cc, dispute it with your cc company.

I did when I recieved a broken XT lap timer. Paypal wouldnt do shit, so I disputed with the cc co. I got my money back screwd paypal who then HAD to chase the Ahole to get theirs back. they sent me a nasty emal, but screw them. I'll use em, but I dont NEED them, should they cut me off.

CC co side with me that yes I got it but was falsely advertised.

P.S. I got to keep the lap timer. I sent it to XT for repair, so in the end it cost me the repair + shipping to and from XT some place around $80

PPS always pay with a CC so you can do this even if you have money in your account

Unfortunately this was the first time I made a large purchase without using the CC my lawyer did tell me to go and dispute it with the bank they may side with me seeing as paypal won't

I don't plan on giving up because if he did it to me he will have no problem screwing someone else and that is just unacceptable to me

Paypal said the only cover goods not the quality of goods so basically they cover f'n nothing anymore. So I have something in the works we shall see what happens that is about all I want to say right now though.

If he still refuses, then request for a POC (point of contact) at the Office of the President and paypal Legal Department. Get the name, mailing address, and other relative information.

Draft an official letters to both departments by stating the facts. Demand if they are not willing to assist you, you'll contact the local DA, BBB, FTC, USPS by filling an official compliant. Also, state that you have the full intentions to contact the local news channels by publicly putting Paypal on the spot lights if they decide to ignore your request.

Make sure to send the letters certified mail with signature required and return receipt. This might cost few dollars more but eliminates all ambiguity with respect to non-refutation claims by paypal.

Lastly, make sure to document all of your conversation, communication, and email. Capture; topic of discussion, time, person you spoke with, and his/her contact informaion (all) or employee ID number.

These steps should get someone's attention and hopefully assist you with this matter.

Do not accept the customer service rep.'s response at Paypal. These guys are measured by amount of time spent in resolving disputes, i.e. the quicker they can close a case the longer they get to keep their job.

Go ahead by calling them back and request to speak with a supervisor in charge. Explain the situation by emphasizing paypal terms and condition should cover your losses. If he still refuses, then request for a POC (point of contact) at the Office of the President and paypal Legal Department. Get the name, mailing address, and other relative information.

Draft an official letters to both departments by stating the facts. Demand if they are not willing to assist you, you'll contact the local DA, BBB, FTC, USPS by filling an official compliant. Also, state that you have the full intentions to contact the local news channels by publicly putting Paypal on the spot lights if they decide to ignore your request.

Make sure to send the letters certified mail with signature required and return receipt. This might cost few dollars more but eliminates all ambiguity with respect to non-refutation claims by paypal.

Lastly, make sure to document all of your conversation, communication, and email. Capture; topic of discussion, time, person you spoke with, and his/her contact informaion (all) or employee ID number.

These steps should get someone's attention and hopefully assist you with this matter.

As of last night everything seems to have worked out for me after a long battle I was sure was lost my bank put the pressure on paypal (after a long investigation with my bank) Paypal had opened an inquiry that was closed last night. My paypal balance is now 0 and my money has been returned to my account. Now if I could only get the paperweight back to him.
